Welcome to PowerSpot. These Terms and Conditions govern your use of our home cinema installation services and website. By engaging our services or accessing our website, you agree to be bound by these terms. Please read them carefully before proceeding.

1. Definitions and Interpretation

In these Terms and Conditions, unless the context otherwise requires:

  • "Company," "We," "Us," "Our" refers to PowerSpot, located at Finsbury Park Road, 14, London, N4 2HH.
  • "Client," "You," "Your" refers to the individual or entity engaging our home cinema installation services.
  • "Services" refers to all home cinema installation, consultation, design, equipment supply, and related services provided by PowerSpot.
  • "Agreement" means the contract formed between PowerSpot and the Client upon acceptance of a quotation or commencement of services.

2. Service Scope and Quotations

PowerSpot specializes in professional home cinema installation services, including but not limited to audio-visual equipment installation, acoustic treatment, lighting design, and system calibration.

2.1 Quotations

All quotations provided are valid for thirty (30) days from the date of issue unless otherwise stated. Quotations are based on information provided by the Client and may be subject to revision following a site survey or if project specifications change.

2.2 Acceptance

A binding contract is formed when the Client accepts our quotation in writing (including email) or when we commence work at the Client's request, whichever occurs first.

3. Pricing and Payment Terms

All prices are quoted in British Pounds (GBP) and are exclusive of Value Added Tax (VAT) unless explicitly stated otherwise.

3.1 Payment Schedule

  • A deposit of 50% of the total project cost is required before work commences.
  • The remaining balance is due upon completion of the installation and successful system demonstration.
  • For projects exceeding £20,000, staged payment milestones may be agreed upon in writing.

3.2 Late Payment

Invoices are payable within fourteen (14) days of the invoice date. Late payments may incur interest at a rate of 4% above the Bank of England base rate per annum, calculated daily from the due date until payment is received in full.

4. Client Responsibilities

To ensure successful project completion, the Client agrees to:

  1. Provide accurate information regarding the installation site, including dimensions, structural details, and existing electrical systems.
  2. Ensure safe and unobstructed access to the installation area during scheduled work periods.
  3. Obtain any necessary permissions, permits, or approvals required for the installation work.
  4. Ensure that electrical supply and other utilities meet the requirements specified by PowerSpot.
  5. Protect furniture, flooring, and other property not directly involved in the installation.

5. Installation and Completion

5.1 Timeline

We will provide estimated completion dates in good faith. While we endeavor to meet all deadlines, completion dates are estimates only and not guaranteed. PowerSpot shall not be liable for delays caused by factors beyond our reasonable control.

5.2 Site Conditions

If unforeseen site conditions are discovered that affect the installation (such as structural issues, inadequate wiring, or concealed obstacles), we will notify the Client immediately. Additional costs resulting from such conditions will be discussed and agreed upon before proceeding.

6. Equipment and Materials

Unless otherwise agreed, all equipment and materials supplied by PowerSpot remain our property until payment is received in full. We reserve the right to substitute specified equipment with equivalent or superior alternatives if the original items become unavailable.

7. Warranties and Guarantees

7.1 Workmanship Warranty

PowerSpot warrants that all installation work will be performed in a professional and workmanlike manner for a period of twelve (12) months from the completion date. This warranty covers defects in our installation work but does not extend to equipment malfunctions covered by manufacturer warranties.

7.2 Equipment Warranties

Equipment supplied by PowerSpot is covered by the respective manufacturer's warranty. We will assist in processing warranty claims but are not responsible for manufacturer warranty terms or limitations.

7.3 Warranty Exclusions

Our warranty does not cover damage resulting from misuse, unauthorized modifications, accidents, natural disasters, or normal wear and tear.

8. Limitation of Liability

To the fullest extent permitted by law:

  • PowerSpot's total liability for any claim arising from our services shall not exceed the total amount paid by the Client for the specific project in question.
  • We shall not be liable for any indirect, consequential, special, or incidental damages, including but not limited to loss of profits, business interruption, or loss of data.
  • Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Cancellation and Termination

9.1 Cancellation by Client

If the Client wishes to cancel the Agreement after work has commenced, they must provide written notice. The Client will be liable for all costs incurred up to the cancellation date, plus any equipment ordered specifically for the project, plus a cancellation fee of 25% of the remaining contract value.

9.2 Termination by PowerSpot

We reserve the right to terminate the Agreement if the Client breaches these terms, fails to make payment when due, or if continuation of the project becomes impractical due to circumstances beyond our control.

10. Intellectual Property

All designs, plans, specifications, and documentation created by PowerSpot remain our intellectual property. Clients may not reproduce, distribute, or use such materials for any purpose other than the specific project for which they were created without our prior written consent.

11. Data Protection and Privacy

PowerSpot is committed to protecting your personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. We collect and process personal data only as necessary to provide our services and fulfill our contractual obligations. 12. Dispute Resolution

In the event of any dispute arising from these Terms and Conditions or our services, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, the parties may pursue mediation before resorting to litigation.

13. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.


14. Amendments and Updates

PowerSpot reserves the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after such changes constitutes acceptance of the modified terms.

15. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms and Conditions, together with any written quotation and project specification, constitute the entire agreement between PowerSpot and the Client, superseding all prior discussions, negotiations, or agreements.
